Silvio Berlusconi Jail Sentence on Tax Evasion Upheld

LOS ANGELES (LALATE) – A Silvio Berlusconi jail sentence on tax evasion has been upheld. Silvio Berlusconi jail or prison for four years was upheld by an Italian appeals court moments ago.

On October 26, Silvio Berlusconi was convicted of tax fraud. The complicated case concerned the purchase of TV rights to films. Among the issue was three thousand U.S. flicks. The court found that Silvio Berlusconi failed to report significant taxes during those transactions. As a result, the court found him guilty and sentenced him to pay a thirteen million dollar fine plus serve four years in jail.

So far, details about the appeals’ court ruling are been filtered to news. The jail sentence has been upheld. It is not yet confirmed but believe that the thirteen million dollar fine has also been upheld.

But as reported on LALATE in 2012, Berlusconi, executives inside his Mediaset group, and the head of a Swiss bank, have two automatic rights of appeal. As CNN reported last year “Also, because the case dates back to July 2006, the statute of limitations will expire next year, meaning there is a good chance that none of the defendants will serve any prison time.”

It is believed that today’s ruling was the first of two automatic rights of appeal. The statute of limitations issue still remains unanswered.

LOS ANGELES (LALATE) – A Silvio Berlusconi jail sentence was ordered today after a decision in one of his many criminal case. But a Silvio Berlusconi jail term won’t be served until all appeals are exhausted, officials tell news.

Today’s Silvio Berlusconi case did not concern the Karima el Mahroug, Ruby the Heart-stealer matter nor the tax fraud case. Thursday’s decision concereds his family-owned Il Giornale daily. The paper published wiretaps connected to a banking scandal nearly seven years earlier. Paolo Berlusconi was sentenced to two years and three months for the wiretaps publication. But today Silvio was sentenced to one year.

In October LALATE reported that Silvio Berlusconi was convicted of tax fraud in other case concerning the purchase of TV rights to films. The court found that Silvio Berlusconi failed to report significant taxes during those transactions. As a result, the court found him guilty and sentenced him to pay a thirteen million dollar fine plus serve four years in jail.

He has two other cases including the Heart-stealer case being resolved later this month. After today’s sentencing, Silvio’s attorney issued a statement to news “I’m not surprised, given that it’s Milan and it has to do with Berlusconi. But I am concerned and shocked because I’m quite convinced that the charges against Berlusconi were weak and contradictory and even completely lacking.”

LOS ANGELES (LALATE) – A $4 million a month alimony settlement agreement has been reached between Silvio Berlusconi and ex wife Veronica Lario. Silvio Berlusconi will make $4 million a month alimony payments to his second wife, Lario. She filed for divorce in 2009. But on Christmas Day, the couple filed paperwork with their Milan judge indicating that they had reached an unusual divorce settlement.

Lario and Berlusconi had begun dating in 1980. In the years that followed, Berlusconi grew to become one of the world’s richest man. The couple would marry in 1990 and eventually have three children. But now with a net worth several billion dollars, Berlusconi saw his marriage crumble after a series of cheating allegations.

In an unusually drafted settlement agreement revealed to news, Lario will get $4 million a month in alimony payments. But she won’t get anything else besides that. Berlusconi will retain one hundred percent of all assets at stake in the divorce proceeding with Lario. She will walk away with no real estate or asset holdings, claims news.

Beyond his massive corporate empire, Berlusconi’s real estate assets are said to be extensive. Among them is Villa Belvedere valued at over 78 million euros. Several other homes are said to be of comparable value. The latest settlement agreement is not too far from the initial demands sought by Lario during the divorce. Berlusconi originally wanted to pay a mere 300,000 euros per month.

A year ago, Silvio Berlusconi battled a scandal with Ruby Rubacuori Heartbreaker (aka Karima el Mahrough, “Ruby The Heartstealer” or “Ruby Heart Stealer”).

Berlusconi supporters told news that the expression “bunga bunga” was never used by the Italian leader, but by friends to refer to only dancing. Berlusconi said at the time that “There was no sacrilegious behavior at my house. This has all been invented by … prosecutors. It’s all the work of the fevered imagination of prosecutors and journalists.”

But today’s ruling concerned a far different issue in the former Italian leader’s life.

But while this case was brewing for years, it was only one trouble for Berlusconi in recent months. In September, his Chi Italy Magazine Kate Middleton scandal erupted news. Berlusconi’s French Closer and Chi Italy Magazine both published the pictures of Middleton improperly, a court found.

Then, in April last year, prosecutors claimed that Ruby and Berlusconi had relations thirteen times when she was seventeen years old. Prosecutors further asserted that the then 74 year old man was having relations with the former Moroccan belly dancer Karima El Mahroug in his private mansions The two had long denied ever having relations. Prosecutors claimed that the leader had relations with thirty-three women in three months. Berlusconi claimed that is physically impossible for any man in his seventies.

LOS ANGELES (LALATE) – The Chi Italy Magazine and website photos of Kate Middleton were released to Italians today. But the Chi Italy Magazine issue on Kate has yet to anger the man who really doesn’t like pictures taken of himself inside his own house, owner Silvio Berlusconi.

The Kate Middleton pictures are being published this week in two magazines / newspapers, French Closer and Chi Italy. Both publications are part of Mondadori, a Silvio Berlusconi owned company. And while Chi editor Alfonso Signorini has been telling news today that pictures taken of someone inside a residence are suitable for print, that was not the position of Silvio Berlusconi three years ago when a similar situation happened to him.

Chateau D’Autet is the scene of the current Berlusconi controversy. But in 2009, it was Villa Certosa. This week, Berlusconi has permitted two publications under Mondadori to run pictures of Kate unclothed inside Chateau D’Autet. But in 2009, Berlusconi tried to halt publication El Pais from running pictures of him and his guests inside his Sardinia mansion Villa Certosa.

In 2009, Berlusconi told news, that in his opinion, the taking and publication of the photos inside a residence as a crime. Niccolo Ghedini, the publisher’s lawyer, said the pictures of Berlusconi’s guests “originated in a crime.” He added “Who buys them anywhere in the world is committing a crime, something which should have been clear to El Pais’ journalists.”

Moreover, Berlusconi specifically called the pictures of him and his guests a violation of rights of privacy. “We’re talking about innocent photos, but there was a violation of privacy.”

Kate has denounced the pictures taken of her as a criminal act. Berlusconi said the same of the El Pais pictures of his guests. “These girls were bathing in a whirlpool bath inside a private home, and they were assaulted in a scandalous way” he told news at the time.

Both parties head to a French court tomorrow as the Royal Family seeks to get an injunction against Closer and further publication of Middleton’s images.

LOS ANGELES (LALATE) – When Kate Middleton Chi photos hit the Italian magazine today, its editor will be ready to defend his decision. But the subplot of the Kate Middleton Chi Magazine scandal is actually rooted near four years earlier.

While Chi Magazine is drawing international outrage today for its choice to publish photos of Prince William’s wife, six years earlier they shocked news by running near death photos of Prince William’s mother.

As noted by the Guardian News today, Prince William was outraged in 2006 when Chi Magazine published near death photos of Lady Diana. The images showed the Princess moments after the Paris car crash, a decade earlier.

This week, William is denouncing Chi once again. In 2006, he and brother Prince Harry called Chi’s publication of photos of Diana the lowest form of decency. He told news at the time that Chi’s decision implied a new “low has been reached” by the Italian Magazine.

This time, Chi has a new editor heading the Italian Magazine. And if you compare editor Alfonso Signorini’s comments today to those of Umberto Brindani back in 2006, you won’t find any consistency. In 2006, Umberto Brindani called near death photos of Lady Diana as appropriate. But today, Alfonso Signorini says that Chi never publishes morbid pictures and always concerns itself with the dignity of the person depicted. “They are natural pictures, there is no morbidity about them, there is nothing that could affect the dignity of the person involved.”

Moreover, Signorini continually tells news today that his pictures should be run because they are “exclusive” and “scoops”. “I am a director of a newspaper not a supermarket, I don’t sell artichokes and carrots, I sell photographic scoops”. He added “Above all, I published them for various reasons, as a journalistic scoop”.

The Royal Family has denounced the publication of the Chi pictures. “Any such publication would serve no purpose other than to cause further, entirely unjustifiable upset to the Duke and Duchess of Cambridge, who were enjoying time alone together in the privacy of a relative’s home,” said an official news statement today. Chi on Monday published not one but two hundred images Middleton. Chi and French Closer are both owned by Silvio Berlusconi’s Mondadori group.  Berlusconi has yet to comment to news about the matter.
