LOS ANGELES (LALATE EXCLUSIVE) – When Mariah Yeater photos and claims first surfaced earlier this week, immediate questions emerged about the child’s interest. In the days that followed, however, most eyes have focused on Mariah Yeater’s pics, not on the issues surrounding the child Tristyn Anthony Markhouse Yeater. But in court documents, Yeater reportedly believes that the child is better off living with her solely that with both his parents, LALATE can report.

When Mariah Yeater petitioned a court in the Justin Bieber matter, she was confronted with several issues about Tristyn Anthony Markhouse Yeater’s future life. Among her answers are a series of peculiar responses, LALATE can report. Yeater claims that Justin Bieber is the child’s father. But when asked if she thinks that she and Bieber should share in legal custody, she declines, asserting that she should have the child’s sole legal custody.

As to physical custody, Mariah Yeater’s desire for the child is the same. Yeater believes that she should have sole physical custody of the child, and not share that with Bieber. Yeater, who is on food stamps, jobless, and lives on public assistances adds a declaration in her petition to the court.

But in that declaration she gives no explanation why the child is better off, solely, with her. Yeater makes detailed assertions that Bieber makes $4.5 million per month, and that she makes no money currently per month. But in another breath Yeater says that the child is better living with her, alone.

Mariah Yeater does not explain in her petition where she thinks the child should reside going forward. She currently lives with the child in San Diego County. But Yeater does acknowledge that the child should have “reasonable” visitation from the pop singer. But beyond, that is vague about the visitations.

Mariah Yeater’s attorneys told news this week that they believe their client’s demands are reasonable. Yet, they give no explanation why Yeater asserts that Bieber should have no custody of the child, but should only get reasonable visitation rights.

Yeater’s interest for the child are additionally in question following her thoughts about his name. Yeater is petitioning for a genetic test to determine paternity (DNA test). If that test concludes Bieber is the father, does Yeater want Tristyn Anthony Markhouse Yeater to become “Tristyn Anthony Bieber”? No, she tells the court. She wants the child to be provided for by Bieber, but for not to have Bieber’s name.

Among Yeater’s monetary demands from Bieber are payment of the child’s health insurance (of which she has none), child support, legal fees for the paternity case, and legal costs for the case. Beyond insurance, Yeater has yet to detail the amount extensively.

Bieber says Yeater’s allegations are a work of fiction. He says the boy is not his, that he did not get Yeater pregnant, and that he had no opportunity to bed her backstage at Staples Center in a restroom following a 2010 concert. To make it even more clear, Bieber says that he has never met her before in his life. DNA testing could begin as early as next month in the case.

LOS ANGELES (LALATE) – Mariah Yeater wants Justin Bieber’s DNA test results. But Mariah Yeater’s mother wanted DNA results also, and got them, against Yeater’s step dad. Paternity disputes have dominated the Yeater – Simeonoff family before. While Yeater is seeking Justin Bieber’s DNA test results this December 2011, Mariah Yeater watched years earlier as her mother did the same against her step dad.

Mariah Yeater’s mother (name still not released) brought a paternity suit against Yeater’s step dad, Anthony Simeonoff. Ultimately, Yeater’s mother prevailed. In 2007, a court ruled in favor of Yeater’s mother, ruling that son Logan was Anthony Simeonoff’s child.

On Thursday, Justin Bieber told news that he is not the father of Mariah Yeater’s son. He also told news that he allegedly never spends time backstage after a concert. Yeater claims to have had relations with the singer after an October 2010 Staples Center concert. Bieber also claims that he has never met Mariah Yeater.

Bieber previously told news through a representative that “We will vigorously pursue all available legal remedies to defend and protect Justin against these allegations.”

Mariah Yeater is asking for a paternity test. To support for her motion, she files a declaration under penalty of perjury. “I am now requesting that Justin Bieber be completed to undergo a paternity test to confirm that he is in fact the father of my baby.”

She adds “I am also request that he provide adequate child support of the baby. (Please also see the declaration I am filing concurrently with additional details).”

Mariah Yeater claims the timing indicates the child is Justin Bieber’s son. “On July 6, 2011, I gave birth to a baby boy. That was exactly 36 weeks and 2 days after the …. encounter with Justin Bieber. Based upon the timing as well as the fact that there were no other possible men that I had [relations] with that could be the father of this baby, I believe that Justin Bieber is in fact the father of my baby. “ If the test is conclusive, Yeater is seeking support from Bieber to “provide adequate support for my baby.”

Mariah Yeater claims Bieber lied to her. “He also said he would give me his phone number after we had [relations]” but that he allegedly didn’t. Yeater claims Bieber found the alleged location. Yeater also claims that Justin Bieber was embarrassed by his alleged “actions” which she claims lasted a mere thirty-seconds.

LOS ANGELES (LALATE EXCLUSIVE) – Mariah Yeater and Justin Bieber’s legal teams will face off in a few weeks. Mariah Yeater’s first hearing is December 15, 2011. Yeater in her court petition is seeking sole legal and physical custody of the boy at issue. But in her Order to Show Cause, Yeater doesn’t mark the “child custody” box.

The first hearing between Bieber and Yeater legal teams will be in Department 7 on December 15, 2011 at 8:45 AM, LALATE can report. Yet Yeater’s Order to Show Cause is filed for “child support”, “attorneys fees and costs”, and “other”. The other is listed as “genetic test”.

In her Application for Order and Supporting Declaration, Yeater also marks “other relief”. She adds that she is seeking a “court order for a genetic test to identically determine parentage.” Discussions about that DNA test and the results of the DNA test are expected to be part of the proceedings on December 15,

Yeater has been under fire by Justin Bieber fans all week. Yet to bring her petition, Mariah Yeater had to reveal substantial information about herself. In public documents, she lists her monthly and annual income, the start and end date of her employment (she is currently unemployed). Yeater discloses her monthly paystubs for public assistance. Her drivers license is published online by websites that chose to run copies of the child’s birth certificate.

Mariah Year also had to disclose her highest level of education. Even though her high school yearbook picture was published online today, Yeater discloses that she never graduated from high school. Yeater does not disclose her parents names, nor if she lives with them.

Yeater is represented by two attorneys. But because she is asking for a waiver of court costs, she also had to disclose her assets, liability and other information in her petition for child support.

She petitions the Court that “I do not have health insurance available o me for the [...boy] through my job” . She adds that the boy “spends 100% of their time with me”. She wants his living arrangements to remain unchanged.

The court ultimately granted her request for a waiver of its fees. “After reviewing your request … the court grants your request and waives your court fees and costs listed below.” Bieber has denied Yeater’s allegations and says he is not the father of her child.

LOS ANGELES (LALATE) – Mariah Yeater’s lawyers today issued remarks about Justin Bieber that appear to conflict with their client’s declaration. Today, Mariah Yeater’s lawyers spoke about the possible path for Yeater and Bieber to handle the manner in a far less public manner. They are urging for swift Justin Bieber DNA results in the case.

Mariah Yeater’s lawyers in their Petition filed this week depict no efforts by them to contact Bieber counsel before the suit was filed. Yeater’s lawyers do not submit a declaration indicating if they made such an attempt to contact Bieber during the pregnancy or before the petition was filed this week.

The sole alleged attempt was made by Yeater, she details in her declaration. She declares that she, by phone, made the only attempt to contact Bieber’s reps. “When I later realized I was pregnant with Justin Bieber’s baby, I tried to contact him through his representatives but no one ever called me back.” She doesn’t declare why her attorneys didn’t contact Bieber. She also doesn’t indicate to whom she specifically attempted to make contact.

But today, Yeater’s counsels are claiming that Bieber should take a less public approach to the matter. “If Justin Bieber is willing to voluntarily undergo a paternity test Ms. Yeater welcomes such cooperation and will be happy to resolve this issue in a less public manner.” The attorneys add “We call upon Justin Bieber and his attorneys to reach out to resolve this issue in a reasonable manner.”

A hearing date is set for December. As first reported on LALATE, Yeater is seeking that Bieber pay her attorneys’ fees ($300 per hour) and costs. Bieber has vehemently denied the matter.

Yeater has petitioned the court to forego its costs based upon her economic level. Yeater has retained two attorneys who do not indicate family law as among their practice areas on their websites; they both handle, however, civil litigation matters.

Mariah Yeater’s son Tristyn Anthony Markhouse Yeater won’t be renamed Tristyn Anthony Bieber if Mariah Yeater (photos below) has her way. Justin Bieber says he is not the father. Mariah Yeater says Bieber is the father, but that she doesn’t want the child to take Bieber’s last name, LALATE can report.

Mariah Yeater has yet to tell news what she chose to make a money demand in her petition suit but not a change of name for her son. In her Petition to Establish Parental Relationship, Mariah Yeater checks “child support”. In subsequent paragraphs including numbers eight, nine, and ten, she asks for Bieber to pay for the child’s expenses.

But in paragraph eleven, the Petition asks about “Name Change” fo the child. The form asks if the petitioner (Mariah Yeater) wishes the child’s name to “be changed, according to Family Code section 7638″? Yeater declines, leaving the box blank.

The Code reads “The procedure in an action under this part to change the name of a minor or adult child for whom a parent and child relationship is established pursuant to Section 7636, upon application in accordance with Title 8 (commencing with Section 1275) of Part 3 of the Code of Civil Procedure shall conform to those provisions, except that the application for the change of name may be included with the petition filed under this part and except as provided in Sections 1277 and 1278 of the Code of Civil Procedure.”

In turn, Section 7636 reads “The judgment or order of the court determining the existence or nonexistence of the parent and child relationship is determinative for all purposes except for actions brought pursuant to Section 270 of the Penal Code.”

If Yeater believes the child is Justin Bieber’s, it remains unclear why Yeater believes it would be in the child’s best interest to have him legal recognized as “Markhouse Yeater”, not as “Bieber”.

Yeater attaches a Declaration to her Petition. In the Declaration, she makes no mention about the name change issue. Rather, she claims that Justin Bieber chose her from an entire Staples Center arena to join him back stage, and then claims he chose her again from a cluster of other young women back stage.

“After waiting for a short period of time with several young women, Justin Bieber appeared and engaged me in conversation. Immediately, it was obvious that we were mutually attracted to one another, and we began to kiss.” She adds “Shortly thereafter, Justin Bieber suggested that I go with him to a private place where we could be alone.”

Bieber told news yesterday he had never heard of the allegations until that day. He denies having fathered the child and calls the paternity claims as hurtful.
