LOS ANGELES (LALATE EXCLUSIVE) – Kandi Burruss claims that Kim Zolciak is a music novice and a horrible friend that went around trying to smear her name on RHOA, according to new documents obtained by LALATE. Kim Zolciak (real name Kimberliegh Zolciak-Biermann) was named as a co-defendant with TuneCore in the original complaint brought by Kandi. But Burruss has dismissed the case against TuneCore. Yet the case has gotten far more heated. In one passage, Burruss now calls Kim a music “novice” who used shameful “offense” “accusation” even against her then “friend”. And as to Kim’s claim that Kandi and Phaedra Parks are after fame from the lawsuit, they say that’s like the “pot calling the kettle black”.
LALATE has obtained Burruss’ 14 page reply brief to Kim’s 27 page motion to dismiss. In it, Kandi’s counsel Phaedra Parks doesn’t mince her words. She claims that Kim is just a bit too hypocritical, not just for reality tv but also for a motion to dismiss.
The reply brief asserts “Throughout much of her Motion, Defendant Zolciak-Biermann makes the patently false and hugely ironic claim that the lawsuit is a mere publicity stunt for Plaintiff Burruss’ new television show. However, Defendant Zolciak-Biermann claim is a classic case of the proverbial ‘pot calling the kettle black,’ as Defendant Zolciak-Biermann is the one who chose to use the disputed work as the title and theme song for her new show, which premiered a week after Plaintiff Burruss’ show.”
Even RHOA comes into the mix. Kim has accused Kandi of money issues in previous reunion telecasts. Kandi says that Kim is a music novice, and that her insults were not just false but also hurtful. “Defendant Zolciak-Biermann continued to make accusations, privately and publicly, that Plaintiff Burruss had somehow taken advantage of Defendant Zolciak-Biermann and her novice status in the music industry. “ Kandi says that she was hurt by Kim’s allegedly false comments. “Being a well-respected music industry veteran and Grammy-award winning producer and songwriter, Plaintiff Burruss took great offense to that accusation, especially coming from a friend.”
Recently, LALATE spoke to the co-composer on Tardy for the Party. LALATE asked the song’s producer and co-composer/songwriter Blade aka The Anomaly why there were four composers on the song’s listing with ASCAP/BMI and who did what.
Blade told LALATE exclusively “Well of course Kandi wrote the lyrics. I made the music. Don Vito was friends with Kandi and he and I had a working relationship at that time so he was somewhat of a middle man for the whole thing. To be honest, I’m not really sure what Kim [Zolciak] contributed as a composer/songwriter, if anything at all, but things work out that way sometimes. I know she definitely didn’t compose anything because that was what I brought to the table.”
