LOS ANGELES (LALATE EXCLUSIVE) – Heather Thomson’s company featured on RHONY is being sued by Spanx. But LALATE can exclusively report that Heather Thomson’s company was sued through 2011 by Maidenform as well in a separate matter.
This week, Heather Thomson has been speaking to news about her feud with Spanx. But in an 87 page Georgia federal complaint obtained by LALATE this weekend, Spanx Inc. is suing Thomson’s company. Spanx is suing Times Three Clothier, LLC , doing business as Yummie Tummie, for Declaratory Judgment. Thomson has yet to file an answer to Spanx, LALATE can also report.
Just two years earlier, however, Thomson was sued by another major brand. Maidenform sued Times Three Clothier in 2010 in a patent matter before the Southern District of New York. The case continued in 2011. Finally, the matter was resolved roughly before filming of the last season of RHONY.
In August 2011, the parties resolved the matter. The court ruled “Plaintiff-Counterclaim Defendant Maidenform Brands, Inc. (“Maiden form”), and Defendant-Counterclaim Plaintiff Times Three Clothier LLC (“Times Three”), have entered into a Settlement Agreement (the “Settlement Agreement”) and agreed to entry of this Agreed Order of Dismissal with Prejudice.” The Court added “Each party shall bear its own respective costs and attorneys’ fees in connection with such dismissal.”
