Casey Anthony Jailhouse Video Tape Released

CORAL GABLES (LALATE) – The Casey Anthony jailhouse video tape has been ordered released. The Casey Anthony jail house tape (video below, screengrab above) features Anthony learning that Caylee Anthony was found dead. The tape was recorded without Anthony’s knowledge on December 11, 2008. Far before Anthony was under fire by a nation, prosecutors were under fire for their actions with this tape.
Moments ago, Judge Belvin Perry ordered that the tape could be released. The tape had been a heated issue before and even after the trial. Prosecutors were accused before the trial of staging the taping. After news choppers were broadcasting live that Caylee’s remains had been found, prosecutors were accused of calling jailhouse officials, bringing in Casey Anthony to a different room, secretly recording her reaction to the discovery of Caylee’s remains, and then trying to use that tape for their trial.
Judge Perry ultimately agreed that the conduct by prosecutors was deplorable. He agreed with Jose Baez that the means by which the tape was taken was suspect and could not be introduced during the trial.
Then after the trial, local news petitioned the court to have the tape released. That petition was initially declined. Today the court agreed to release the tape. The court found that Anthony’s interests had been served and was not longer in jeopardy by release of the tape.
In 2008, LALATE first reported about the controversial footage. Anthony was in the Orange County jail at the time. The Sheriff’s Office thereafter learned that human remains had been found on Suburban Drive. The prosecution had already been under fire for filtering damaging information about Casey Anthony to the news media since her arrest.

On December 11, 2008, local TV programming was interrupted by live breaking news coverage from Suburban Drive on the human remains. The Sheriff’s Office thereafter called over to the Orange County jail. They instructed officials to move Casey Anthony into a room in which the TV broadcast was airing. An Orange County Corrections lieutenant then secretly taped Casey Anthony’s reactions.
The video had no sound. Orange County Corrections lieutenants quickly leaked to news their impression of Casey Anthony’s reaction.
Casey had no knowledge why she was brought into the room, nor that the room had surveillance tapes recording her response to the TV news coverage. The prosecution then sought to use those tapes as evidence.

Jose Baez called it an outrageous attempt by the State to taint the jury pool in advance of jury selection. The Court eventually agreed with the defense. The Court ruled that the State’s releasing the video to the news media would cause the jury pool to be tainted.
Today, Judge Belvin Perry ruled that the interest in a fair trial was no longer an issue. He denied the defense’s claim that the tape’s release violated medical privacy law. Defense had argued that the tape was recorded in a jail medical facility and that Anthony was on medication at the time. Below is the video tape.
