Casey Anthony Premeditation - First Degree Murder Appears Unlikely

CORAL GABLES (LALATE) – The case for Casey Anthony’s premeditation fell apart last week. Casey Anthony premeditation must be shown by the State to establish first degree murder. Over the weekend, most readers here and news analysts agreed that the case for premeditation has not been proven. But as the Anthony trial starts again Monday, expect the defense to battle the case for felony murder and the charge for aggravated child abuse. But, if by the time the jury gets this case the charges of first degree murder, felony murder, and aggravated child abuse have ALSO not been proven, what could happen to Casey Anthony? The answer is simple: aggravated manslaughter or acquittal.

The problem with the State’s presentation of its case was the concentration on first degree murder. In truth, the State could have spent less time on first degree murder and focused more time on felony murder, aggravated child abuse, or aggravated manslaughter. But the State hasn’t.

On Thursday, when Cindy Anthony left the stand, a nation believed the State’s case was in trouble. In truth, the State had already set itself up for trouble by pushing for first degree murder. But will the jury get confused as well?

The State hasn’t proven first degree murder. It requires premeditation and an intentional killing. If you believe that Casey didn’t intent to kill Caylee, there is no first degree murder. If you believe that Casey did intend to kill Caylee but did so in the absence of premeditation, there is no first degree murder. First degree murder is premeditated murder.

The State asserts that Caylee’s killer plotted her murder. The State claims the killer used chloroform and suffocated Caylee by duct tape. The State hasn’t proven that Casey even had access to the duct tape, let alone plotted to use that duct tape. The State, because of Cindy’s testimony, hasn’t proven that Casey planned to kill her daughter with chloroform either.

How about felony murder? Felony murder requires the State to prove that Caylee died while Casey was committing a felony. The felony here is aggravated child abuse. To prove aggravated child abuse, the State must prove that Casey intended to drug Caylee with chloroform.

Here too the State’s case is week. Did Casey intend to drug Caylee on chloroform? The State hasn’t put Casey with the chloroform. The forensics and witness testimony hasn’t established that Casey gave chloroform to Caylee. If the State doesn’t put Casey with the chloroform, there is no aggravated child abuse, and hence no felony murder.

So if the State hasn’t proven first-degree and felony murder, what is the State left with? As previously covered on LALATE, there is only two possibilities left: aggravated manslaughter or acquittal.

Even the aggravated manslaughter is problematic. Why? The State must prove that Casey acted in reckless disregard of human life. The State must prove that Casey knew, or should have reasonably known, that her actions towards Caylee would likely cause death or great bodily injury. But what were Casey’s action? We just don’t know. The problem is we don’t know how Caylee died.

ORANGE COUNTY (LALATE) – Vicki Gunvalson boyfriend questions dominated a Watch What Happens Live Sunday edition. Vicki Gunvalson’s boyfriend was not identified on air (his name is Brooks Ayers, photo below) but the OC Housewife responded to questions posed by host Andy Cohen.

After Sunday’s NJ Housewives broadcast, Cohen posed his first viewer question to Vicki Gunvalson. Cohen said that Vicki the last two weeks has really battled a series of news reports. Without making reference, the insinuation is a June 17 article by Radar entitled “Vicki Gunvalson’s Boyfriend Has another arrest for DUI”, a June 15 article entitled “O.C. Housewife Vicki Gunvalson’s ‘Deadbeat Dad’ Boyfriend — The Mug Shot”, and a June 18 article entitled “Vicki Gunvalson Has Been Involved With New Boyfriend”.

OC Housewives don’t generate an enormous amount of press. But in recent memory, Vicki has rarely, if ever, been the subject of three news reports in just one week. Cohen didn’t mention the particular news reports he was referencing but he did reference Vicki’s new boyfriend was the subject. What was her response?

“The media doesn’t tell the whole truth” said Gunvalson.
As to reports that claimed Gunvalson didn’t know about her boyfriend’s past, Gunvalson said “I knew everything. There wasn’t any secrets and lies.”

Cohen then posed Gunvalson an interesting question. He asked her what her thoughts were about Slade Smiley’s child support and allegations of being a deadbeat dad by Tamra Barney.

“If the viewers saw me the last year” Gunvalson said “I never talked about Slade. It’s his business and his life and I don’t want him in mine.” Viewers may disagree that Gunvalson didn’t speak about Slade this last season of OC.

Cohen then asked Gunvalson about Tamra’s determination to discuss Slade all last season. Gunvalson said that was difficult for her because “Tamra is my best friend. I personally would not have gone that far.” She added “I don’t want people in my business … I’m a big girl … everyone needs to have a fine line where you stop.”

Finally Cohen asked if Gunvalson is “still in love?” She smiled and said “Yes.”

CORAL GABLES (LALATE) – Will the Casey Anthony trial call Roy Kronk to the stand Monday? The Casey Anthony trial on Monday won’t call George Anthony but will call Roy Kronk, predicted bounty hunter Leonard Padilla to news this weekend. Jurors got a longer than anticipated break this weekend after testimony was cut short early Saturday. Later that day Padilla told news that he predicts George Anthony will definitely not be called next week. But he adds that the case will “go down Niagara Falls” if Kronk is called to the stand, by either side.

What would be the purpose of Roy Kronk’s testimony? News analysts predict that the defense will address two subjects with Kronk – the reward money, and the skull’s condition.  Kronk is expected to be used in conjunction with Dr. Werner Spitz’s testimony. Spitz has previously told the jury that Caylee’s duct tape was added to her face after she died. Spitz asserted that following decomposition the notorious duct tape was added to her face along with the heart shaped sticker.

He said that Caylee did not die of suffocation from the duct tape. Rather he said that someone applied duct tape to her after death  to prevent the jawbone from detaching. Spitz told the jury that conduct after investigation of the skull was outrageous, unprecedented, proof of “a shoddy autopsy”, and a violation of all tenants and procedures by which autopsies are done.

Kronk would be called as hostile witness. It’s a difficult path for Jose Baez to take since Kronk will assert that the duct tape was in place when he found Caylee’s skull.

Dr. Jan Garavaglia (Dr. G.) did not open up the skull during the autopsy of Casey Anthony. “There’s is no child that should have tape on their face when it dies” Dr G told the jury. “There is no reason to put it on their face after it dies.” But Dr. G. could not establish that Casey put the duct tape on Caylee’s mouth.

News analysts are not so sure that George Anthony won’t take the stand Monday. Both, conditions about the pool, computer searches on the Anthony computer, locations of the duct tape roll in the Anthony household, and the relationship between Caylee and Casey are all testimony that Baez can get from Cindy Anthony without the need of George ever taking the stand.

Chicharito, Barrera and Dos Santos Fan Celebrations Continue Across Southland

LOS ANGELES (LALATE) – Mexico soccer fan celebrations for Chicharito, Barrera and Dos Santos continued into the evening last night, and still are going strong this Sunday across the Southland. Local telecast news are asking Mexico soccer fans today which three turns of the Copa Oro were the most exciting – the passes by Chicharito (Javier Hernandez), the two goals by Pablo Barrera, or the final goal of the match by Giovani Dos Santos. For fans, it all added up to one of the most exciting, and now most celebrated, soccer matches of the year for the Southland.

Coming into Saturday evening’s match from the Rose Bowl, many local merchants that typically sell Chicharito’s jerseys closed early. Locals that couldn’t make it to the Rose Bowl gathered around televisions in communities at homes or bars. Goals prompted cheers that could be heard up and down the streets of the Southland.

By evening, the celebrations continued into the night. Tourists that had made the travel to Los Angeles for the game flooded into the corridors from Pasadena’s Old Town to Downtown Los Angeles. And yet, for Mexico soccer fans, it was a tense game, initially at the beginning. Chicharito initially could not score, but kept on striking. With the US up 2-0, Javier Hernandez’s multiple attempts to score kept on missing.

But then late in the first half, Pablo Barrera, arguably the star of the game, came up with a stunning goal. After another goal, Mexico was tied going into the half.

A game that featured an early advance by USA in the first half seemed entirely different after the break. Landon Donovan and teammates lacked timing, defense, and explosiveness. Tim Howard’s error late in the game certainly gave Mexico its final goal, but USA just never seemed to get their footing even at the start of the second half.

Pablo Barrera came back with another goal, his second. The same player who put Mexico back into the game in the first half now put his country into the lead. Hopes for Howard and his team, however, were destroyed when he was drawn out, and then Giovani Dos Santos struck with the final goal, giving Mexico the 2-4 win.

For  soccer fans,  another great showdown comes next week as well with Chile vs. Mexico 2011, their first CONMEBOL, 2011 Copa America match, on July 4, start time at 9:45. Their second Group C round is Peru vs. Mexico four days later, at the same time.

Casey Anthony Trial Prosecution Could Lose First Degree Case

CORAL GABLES (LALATE) – The Casey Anthony trial could result in the prosecution losing their  case if the attempt to push the first degree murder charge. The Casey Anthony trial drew criticisms of the defense, left and right, a week ago. News analysts, quick to sensationalize coverage of the trial, called the forensics testimony by the defense as boring, ineffective, and a game losing strategy. But with most of us able to better grasp witness testimony over forensic evidence, the Casey Anthony trial changed on Thursday. Now with hardly any testimony until Monday since the explosive remarks by Cindy Anthony and Lee Anthony, the question remains: is the State losing their case?

The answer as to first degree murder is an emphatic “yes”. The problem with the way the State has charged Casey and presented the evidence is that they have used the first degree murder charge, not the manslaughter, as the focus, direction, and theme of its evidence presentation. The State has introduced its evidence, and conducted last week its cross examinations, in the context of first degree. The Bella Vita tattoo pictures, the skull pictures, the party photos, are all put within the context of premeditation. If that context fails, that the story behind the State’s case gets confused.

The biggest word troubling the jury this weekend is probably “premeditation”. Even if you believe that Casey was responsible for Caylee’s death, do you believe as a juror that she planned Caylee’s death? The State’s assertion is, yes, because the Anthony family computer had searches for chloroform. The defense, however, destroyed that theory last week by proving that the searches weren’t done by Casey. In fact, the State has no evidence that it was Casey on the computer, specifically.

So when Cindy said she was on the computer, and she did the searches, the State had a huge problem. Yes, Cindy searched for “chloroform” but not “how to make chloroform”. But that nuisance is not enough to get at premeditation.

How many jurors before this trial ever looked up the word “chloroform” in their life? If the answer is none, and now they are hearing assertions that two family members are looking up the same peculiar word, with Cindy on “chloroform” and Casey on allegedly “how to make chloroform”, it’s going to be confusing.

For a juror to come to the determination that someone premeditated, not just a murder but the murder of their own daughter, there can’t be this mess of confusion in the evidence. There can’t be question about search activities on the computer.

Additionally, while legal analysts brushed over it on Friday, one of the most powerful pieces of evidence was a video showing Casey and Caylee in love, a video that drew tears from the witness (Cindy) and the defendant (Casey). If a juror wants to find premeditation, they have to come to a determination that somewhere, for some reason, this loving mother turned into a monster and plotted to kill her daughter.

Why did Casey allegedly become a monster and plan to kill her daughter? Because she wanted to go party and have tattoos? Casey’s party photos and Bella Vita tattoos are bizarre. But seeing a defendant act weird, especially from this family, doesn’t help a juror jump to the conclusion of premeditation. It helps for manslaughter, but not for first degree murder.

What makes the Casey Anthony trial unlike anything this nation has ever seen is not just the unanswered questions but the hard-fast resolution of the State that they have a first degree murder case, which they really don’t, and the resolution by Jose Baez that he has a case involving George Anthony, which so far he doesn’t have at all.

We don’t know what went on with Casey and Cindy and Lee. But this week we also realized the bigger mystery is why have the State and the defense not seen the massive voids in their cases so far that you drive a truck through.

The trial is far from over. Testimony could continue until the middle of July. The defense has multiple key witnesses still not called. The state has a critical rebuttal coming up. But for now, the Casey Anthony trial has not shown itself to be a first degree murder conviction case.

LOS ANGELES (LALATE) – Caroline Manzo has rid herself of Danielle Staub’s war, but now a new ratings war is growing, as Dina Manzo and Danielle Staub battle for viewers with all new reality shows premiering this July one day apart from each other. While New Jersey Housewives this week move to Sunday nights, it’s there that the Manzos could soon battle Danielle Staub with her own support from ironically … Three 6 Mafia.

On July 10, Staub and Three 6 Mafia join the case of the hideously unoriginal concept “Famous Food” for VH-1. For the series, the producers take one existing notable eatery, close its doors, and reopen with a new name aided by a cast of characters. Tables won’t be flipped in this show. Rather the cast includes Heidi Montag, Jake Pavelka (“The Bachelor”), and Vincent Pastore (“The Sopranos”). The show ironically airs at 10 PM EST.

One day later, Dina Manzo premieres in a new show, with a new network. On July 11, Manzo joins Food Network personality Paula Deen, Nate Berkus and Kathy Ireland to become the judges for HGTV “Design Star” sixth season. Thom Filicia and Robert and Cortney Novogratz will guest judge. Former ‘HGTV Design Star’ winner David Bromstad will join the cast.

Will the cast of Design Star have to design a New Jersey mansion on a bankrupt bank account? With the cast of Famous Food ever applaud Danielle’s dishes as fabulous? Fans will find out this July.
