Cindy Anthony Testimony Didn't Change from Deposition



CORAL GABLES (LALATE) – The Cindy Anthony testimony you heard today in the Casey Anthony trial was not a change from her deposition, claimed Anthony attorney Mark Lippman. The Cindy Anthony testimony today about chloroform, how to make chloroform, and stains inside the Pontiac Sunfire was quickly dubbed “bombshell” testimony”, “changing testimony”, and a shocker by news. But Lippman tonight told news that Cindy Anthony’s testimony today at trial was the same that she gave in her deposition in 2009.

Cindy Anthony was called by Jose Baez on his defense case-in-chief Thursday. Baez initially asked Cindy Anthony about her work timesheets, then about the Pontiac Sunfire, and finally about her online searches.

Cindy Anthony first said that her timesheets are not a far indication if she was or wasn’t at home on March 17 or March 21. Rather, she said that her employer prohibited overtime hours so often she would have to accountant for her hours by listing extra days.

The State seemed shocked by Cindy’s assertion that she was home that day. Lippman implied the State was acting up for the jury. Why? He says that they asked Cindy in her depo about her search activities online at home those two days. He said they didn’t rule out her being at home, and even asked her about questions presuming she was at home and the work logs were inaccurate.

Second, Cindy Anthony said that she and husband George Anthony bought the Pontiac Sunfire for Lee Anthony. She said that when the Pontiac was bought it had those stains in the trunk. The State has claimed the trunk stains came from Caylee Anthony. No, said Cindy Anthony today.

Finally, Cindy Anthony was asked by Jose Baez if she searched for “chloroform” on March 17 and March 21. She said yes. As a nurse, she said she was concerned that one of her dogs was acting peculiar. Cindy Anthony said the same during her depo, said Mark Lippman tonight.

On cross examination, the State wrongly implied that Cindy had changed her testimony. Cindy Anthony said no. Anthony reaffirmed her depo in stating that she did not look up “how to make chloroform”. But she asserts that she looked up “chlorophyll” and “chloroform” and that both of them sent her to results for “how to make chloroform.” She also reaffirmed her depo that she didn’t look up “neck breaking”. But she said she did look up something else and then linked on a search engine result on “neck breaking”. She described it as a YouTube pop-up of a skateboarder engaged in a “neck breaking feat.”

As to the websites visited about “chloroform”, she said those were done by her. The words she ruled out are “shovel” and “self defense”. But all other chemicals like “acetone” will all looked up by her, as a nurse and owner of dogs worried about their condition.

On cross, the State failed to impeach Cindy Anthony on the log-in theory. The State asserts that Cindy didn’t have log-in credentials to the computer. But Cindy said the computer would stay on for days, if not weeks, and she would just simply sit down and began using it.

Mark Lippman tonight told CNN’s HLN Prime News that the Anthony family does agree with the State’s case and does not agree with the defense’s case. He said George Anthony had nothing to do with Caylee’s death. He added that Lee Anthony and George Anthony did not abuse Casey.

Earlier this week, LALATE reported that the State’s first degree murder charge is in big trouble of falling. Tonight it likely that Casey Anthony may not be found guilty of first degree murder.

For first degree murder, the State must prove premeditation or aggravated child abuse. The premeditation hinged on the theory that Casey Anthony did the searches on the Anthony computer. Tonight there is unequivocal doubt about the searched. The aggravated child abuse case for the State is nonexistent.

If on rebuttal, the State is unable to come back with strong evidence to rebut Cindy Anthony’s testimony, they could be faced with an aggravated manslaughter. LALATE has previously predicted that Casey Anthony will either get an aggravated manslaughter guilty verdict, or innocent verdict, with the aggravated manslaughter more likely.

Of note, Casey was initially never charged with first degree murder until the State uncovered the online searches. Up until March 2009, the State wasn’t seeking first degree murder against Anthony. Weeks later they added the charge.

CORAL GABLES (LALATE) – Cindy Anthony, currently on the stand in the Casey Anthony trial, today possibly saved her daughter from a first degree murder verdict today. Cindy Anthony searched for “chloroform”, not Caylee Anthony, and reviewed search results on “neck breaking”, she told an enraged State attorney on cross examination. The State’s entire first degree murder case requires evidence of premeditation or child abuse. With no evidence of child abuse, the state has hoped that searches for “chloroform” on the Anthony family computer could establish premeditation. Today, Cindy Anthony destroyed that State theory.

Cindy Anthony basically told the jury today that the vast amount of  online searches, and computer activity on the Anthony family computer at issue in this case, were done by her, not by Casey.

Cindy Anthony said she was looking up “chloroform” because, as a nurse, she was worried it was something the dogs had eaten. She told the State she looked up the word. When the State asked her if she did the search “how to make Chloroform”, Cindy said she searched “chloroform” and that the search engine gave her “chains” of results on “how to make chloroform”.  She said she clicked those search engine results, and spent substantial time, perhaps eighty or more page loads, on websites about chloroform.

The State ineffectively tried to impeach Cindy. It stated that during her depo she searched for the erroneous word “chlorophyll”. She said she did, but that the search results corrected her spelling to “chloroform” and then to “how to make chloroform”.

Cindy Anthony said she did not look up the words “shovel” or “self defense”. But she did look up “inhalation”, “alcohol”, “acetone”, “peroxide”, and “hydrogen peroxide”.

When asked if she looked up “neck breaking”, she said no, but that she did review “neck breaking” search results. She said “there was a YouTube popup about a skateboarded on rails and it told me it was a neck breaking feat.”

ST LOUIS (LALATE) – Joseph Anthony Davis and Frederick Domingue Jr have been arrested on terrorism and firearms related charges. A mug shot photo for Davis has been released by FBI officials. Today they confirmed to news that Abu Khalid Abdul-Latif, aka Joseph Anthony Davis, and Walli Mujahidh, aka Frederick Domingue Jr., of Los Angeles, were arrested last night after they allegedly plotted an attack against the Military Entrance Processing Station (“MEPS”) on East Marginal Way in Seattle.

Davis is a 33 year old resident of Seattle. Domingue is a 32 resident of Los Angeles. Both obtained machine guns to plot an attack against the Seattle MEPS, a federal indictment claims. The two defendants also intended to attack the Joint Base Lewis-McChord with the use of grenades and machine guns, the complaint asserts.

Law enforcement had been monitoring the two in recent weeks and had been able to render their weapons inoperable without the defendants’ knowledge. United States Attorney Jenny A. Durkan told news today that he was aided by a joint task for the FBI, Seattle’s Police Department, and the Joint Terrorism Task Force.

Seattle Police Chief John Diaz applauded the joint effort in a news statement today. He said that resources were pooled form local, state and federal agencies. “The complainant felt safe approaching a Seattle Police Detective and, in doing so, ended the plot intended to take innocent lives. This cooperative investigation involving local, state, and federal partners worked exactly as intended” said Diaz.

Abdul-Latif and Mujahidh face potential sentences of life in prison if convicted of the charges, said the news statement.

LOS ANGELES (LALATE) – USA vs. Mexico 2011, the Gold Cup Finals match, is set for Saturday with Chicharito (Javier Hernandez) telling news that Mexico will win. USA vs. Mexico (start time 6 pm PST) is the result of Hernandez’s history making performance this 2011 Gold Cup. Last night, Hernandez made news delivering the seventh goal for Mexico, the second most ever by a player in a single Gold Cup. The record is set by a fellow native star, Luis Roberto Alves, who delivered eleven goals in 1993. And while Javier Hernandez was the biggest thing to hit the field for Manchester United this year, last night one of his USA opponents praised him across international news.

Aldo De Nigris and Chicharito on Wednesday delivered stunning goals at Reliant Stadium to advance Mexico to the finals. But last night, it was Landon Donovan who praised Chicharito as the best striker into he world. “They’ve got perhaps the hottest striker in the world on their team right now.”

Donovan told news that Chicharito doesn’t impress with every move; rather Chicharito never misses when key opportunities to strike come available. Donovan added that Chicharito is able to change the pacing and direction of games, instantly, because of his explosive, sudden responses on the field.

USA advances to the finals following  its win against Panama. USA’s Clint Dempsey delivered a stunning goal in the 77th minute after an assist from Donovan. USA hasn’t lost this tournament since it fell to Panama on June 11 2-1. Dempsey also scored in USA’s quarterfinals win against Jamaica.

Honduras fell to Mexico last night in extra time. Mexico and USA have not faced off in the finals since 2009.

USA has appeared in eight finals, four consecutive. Tickets to see the finals are now drawing nearly a thousand dollars per seat. The match kicks off en vivo from the Rose Bowl in Pasadena this Saturday at 6 pm.

And while Chicharito predicts a big win Saturday, he never considers himself the hero. “The most important thing is that there are no heroes – it’s all about the effort of the team and my goals are down to my team-mates.”

CORAL GABLES (LALATE) – Cindy Anthony is expected to take the stand in the Casey Anthony trial, again, today. Cindy Anthony’s trial testimony dominated the State’s case-in-chief. But on Thursday, Jose Baez is expected to bring Cindy Anthony back on the defense’s case-in-chief. If true, Cindy Anthony could be the first percipient witness called by Baez not discussing forensic testimony. Cindy Anthony is expected to start a Casey Anthony defense witness list that will encompass multiple Anthony family members and an alleged mistress.

Baez has previously hinted through other witnesses what he is expected to draw out of Casey Anthony’s mother. Cindy Anthony is expected to tell the jury more testimony about access to the duct tape, access to the family computer, and allegations of infidelity by her husband.

Cindy Anthony has previously told jurors on the State’s case that she and George Anthony, solely, had access the duct tape. The State, however, asserts that Casey Anthony used the same roll of tape to cover Caylee Anthony’s mouth and suffocate her.

The State has also previously asserted that Casey Anthony searched the family computer for keywords like “chloroform”. Those searches are the basis of the State’s assertion of premeditation. Baez is expected to question Cindy Anthony about access of that computer by family members.

Cindy Anthony’s trail testimony comes at a peculiar time. Her attorney, Mark Lippman, granted interviews to CNN last night. He will appear on CNN’s HLN Prime News tonight again.

CNN reporter, Gary Tuchman, last night asked Lippman if Cindy and George Anthony think Caylee is guilty. While Tuchman didn’t ask specifically which charge he was referring to, Lippman said that Anthony family thinks Casey is guilty. But in a follow-up statement, Lippman to “clear any misunderstanding” said that the Anthony family does not want Casey to get the death penalty.

“I asked him a very specific question, I said, ‘Do your clients, George and Cindy Anthony, think that she is not guilty?’” Lippman said. “[H]is answer was, they do not think that. He said they want to see justice done, they want to see the truth come out, and then he added to me, he said, they do not believe she is innocent.”

Casey Anthony Guilty Verdict Possibility Depends on Final Witnesses


CORAL GABLES (LALATE) – A Casey Anthony guilty verdict will depend on the veracity of her final defense witnesses. Casey Anthony’s chance of a guilty verdict seemed high after the State’s case. But while a series of pundits have dominated late night news coverage denouncing how poorly they contend Jose Baez has presented his defense case, other news analysts, and several leading publications hitting stands this week (including PEOPLE), firmly disagree. One thing that both sides of the debate have agreed upon is that Jose Baez’s presentation of forensic testimony has been slow, introduced in a boring monotone delivery.

But that could all change Thursday. LALATE has previously asserted that an aggravated manslaughter guilty verdict, not a first degree homicide verdict, seemed more likely after the State’s case. But starting today, Baez is expected to present evidence to go at even the chance of an acquittal.

The State has not proven enough for premeditation or aggravated child abuse. Either is required for a first degree murder conviction that would result in a death sentence. Besides the initial word searches on the Anthony family computer, the State has yet to present convincing evidence of first degree murder.

But did Caylee even die of manslaughter, or was it an accident? Legal pundits have wrongly made two assertions about Baez to date.

First they claim that his opening statements were unsupported by any evidence. That appears not to be the case. Baez in the opening statement said that George Anthony had a fake job and was lying to his wife about what was going on his life. He also said that Anthony told another person that Caylee Anthony died of an accidental death.

On Thursday, Baez is expected to call the woman who has confessed to both assertions. Her name is Krystal Holloway who also goes by an alias, River Cruz. As previously reported on LALATE, Krystal Holloway will testify that George Anthony was having an affair, that she was his mistress, and that he confessed that Caylee died accidentally. She also will assert that George Anthony was lying to his family, that he was getting money from her to portray himself as having a job that he didn’t have.

George Anthony’s attorney has been feverously issuing news statements this week denouncing Krystal Holloway, her sister, and their statements as false. But unless George Anthony takes the stand, the jury will hear Holloway.

Second, some pundits have asserted that Baez has not put up a good defense so far and has bored the jury. But his forensic testimony has been effective. He has established the absence of key elements to link Casey Anthony to Caylee’s death. There is no DNA nor blood in the trunk, on Casey’s belongings, or on the duct tape. There are questions as to whether the duct tape was applied after the fact to Caylee’s skull. There questions as to whether Casey ever had access to the tape with Cindy Anthony saying she did not. You simply don’t have a link between Casey Anthony and the alleged murder tools.

News analysts have fretted over the lack of excitement in the Casey Anthony trial since the defense began. But forensic testimony is not exciting. Jose Baez has been ineffective in his vocal delivery of the forensic testimony. His monotonous voice has made great testimony sound the same as poor testimony, leaving jurors unsure of his wins and losses on direct. But the forensic findings have been good.

Today, however, Baez is expected to switch from that boredom into powerful, disputed, witness testimony to go at an acquittal verdict. With the State having not proven a first degree murder conviction, these final witnesses could determine if Casey gets and aggravated manslaughter verdict, or a verdict of acquittal.
