Casey Anthony Aggravated Manslaughter Guilty Verdict Won't Need Premeditation


LOS ANGELES (LALATE) – A Casey Anthony aggravated manslaughter guilty verdict, ending with a possible life in prison sentence, is appearing more likely as Anthony’s defense case progresses. Prosecutors are seeking a guilty verdict on first degree murder (requiring premeditation or aggravated child abuse) but have also charged Anthony with aggravated manslaughter. But as the Anthony defense continues to proceed after a State case that lacked motive, premeditation, and evidence of child abuse, Anthony – if the case progresses how it has – is unlikely to get first degree murder.

To date, only one woman has received the death penalty for the death of her child. Just last month, Amanda Brumfield, Billy Bob Thornton, was charged exactly as Casey Anthony in a separate case. Brumfield was found not guilty of first degree murder and was convicted of aggravated manslaughter. In July we will learn her sentence.

Anthony has pleaded not guilty to all her charges: first-degree murder, aggravated child abuse, aggravated manslaughter of a child and four counts of lying to law enforcement. As local news recalls, until March 2009, the State wasn’t seeking first degree murder against Anthony. Weeks later they added the charge.

It remains unclear what prompted the State to add the first degree charge. It may have been the result of tests on the Anthony household computer. For Casey, her online searches of words like “chloroform” remain the few, and not so convincing, possible suggestions of premeditation. With cause of death, location of death, and DNA and blood evidence lacking or inconsistent to date, the State has struggled to show motive, aggravated abuse of Caylee, or premeditation.

A guilty verdict for aggravated manslaughter could result in a sentence of fifty years to life. But the obvious question remains if Casey could still be found not guilty.

Legal analysts claim that Jose Baez made a strategic error in his opening statements of presenting a defense of accidental drowning and family abuse. Now on his defense case, Baez has yet to default to either such defense. Rather he has been, expert by expert, putting up a traditional forensic-driven defense case; he has still not offered any evidence of a swimming pool or an allegedly abusive father and brother.

That could change. Baez is expected to call George Anthony and potentially his alleged mistress Krystal Holloway aka River Cruz. She claims that George Anthony confessed to her that Caylee died of a swimming pool drowning, allegedly stating “it was an accident that snowballed out of control.”

    CASEY ANTHONY SHOULD BE HAPPY SHE IS WHITE IN AMERICA!!

    Nearly two years ago I stated that Casey Anthony would receive “white American Justice” and would be found “Not Guilty”! This type of justice has been practice forever! It is one of the reason that American justice system is polluted piss poor and not fair. With racial bias and white privilege! White judges and white juror many times find it hard to convicted a plaintiff. That looks like their sister or brother daughter son dad or mother!

    That has been American history forever! Next will come the books then the movie. Then Casey Anthony will do the morning shows. She will get a agent and toward schools and municipality. In other words like Billy the Kidd. Or the many white criminal that become celebrity after many times killing other white people! Casey going to get RICH! Casey Anthony in my opinion is guilty of murdering her daughter. Or she knows who did!

    Many times throughout the trial the white control media tried to compare. This trial to the OJ trial. WRONG WRONG WRONG! OJ got off because of the racist Mark Fuhrman. Who stated that he planted evidence, one black people to gain a arrest in the pass. The juror heard his testimony and drew from his statement! Another thing the OJ trial was unusual and not a American practice. In The Anthony case her father a ex police officer smell dead in the truck of Casey car. Did nothing even those his grandaughter was missing 14 days! Casey told many lies and was caught in her lies!

    Casey Anthony better be happy to live in America and be white! She better be happy that a majority white juror base their decision on race! She better be happy that in American society. They will not criticize the jury like they did in the OJ Simpton trial! Casey will be RICH RICH RICH! Her child will still be dead and not receive any justice! White on white crime will continue to not be address. The country will walk run drive fly to buy the book and see the movie! GOD BLESS Caylee sorry you where born in America!

    Prosecutors were forced to rely largely on circumstantial evidence. I commend the jurors for listening to the evidence and not listening to the media. Popular television shows like “CSI: Crime Scene Investigation” has influenced jurors in recent years, by giving them the false impression every case has the same clear-cut forensic evidence featured in that fictional series. This just isn’t true. Because of the tragic nature of 2 year-old Caylee Anthony’s death, many in the public felt someone must be held responsible and they saw Casey Anthony as that person. Jurors must hold to a higher standard than the average citizen watching on TV. That standard is guilt beyond a reasonable doubt. Prosecutors alleged that Casey strangled her daughter with duct tape and dumped her body in nearby woods. The defense said Caylee Anthony accidentally drowned in the family pool and the family failed to report it. Without ANY direct evidence, how can anyone condemn a person to the death penalty?

    no matter what, she is guilty of not reporting her daughter as missing or dead….that should be enough to put her in jail for considerable time…..i know somebody who lost custody of her children to the state for 6 months for leaving her children in the hands of an inadequate childcare provider….i forget the terminology for the reason but she went to work and left her children with the youngest child’s father…when mom got off work she realized that the middle child, a 2 year old girl was very ill and she collapsed when she stepped out of the car when they got home….mom asked her boyfriend, her baby boy’s father for those not paying attention, whats wrong and he said that shes fine just let her be…mom waited a little while but when her little girl was still vomiting she took her to the er where she found that that her daughter’s intestines were ruptured and she had to have immediate surgery to remove 6 inches of intestine in order to save her life…the boyfriend went to jail for abusing the child…it turns out the little girl was crying in the back seat and he slammed the brakes which caused the seat felt to jerk her stomach violently…he got jail time for lying about this and she lost her kids for leaving them in his care even though they were engaged and he was her youngest childs father…he also had a 6 year old son whom he raised alone which speaks for his ability to take care of children….this justice system is turning into a joke

    @s and @tyrone You both look like morons. First of all there is in fact white privilege in America (the discrepancy between conviction rates of white collar vs street crime). To deny it is ignorant of the very reality of the situation. Simply because we have a black president (or any of those other bits of mediocre evidence people are likely to bring up) don’t really mean a whole lot. Also, shut up about OJ. No one cares. That was almost 10 years ago and the dummy’s in jail anyway. Lastly, if you’re going to call someone an idiot, you ought to do it with at least correct grammar (where-were, then-than, etc). You guys suck, and make me sad.

    Yes, the verdict is not guilty and we are all shocked and angered by this verdict. I have given the situation considerable thought and have come to the conclusion that the American judicial system has 2 serious flaws. Basically we have only 2 possible verdicts.

    1. Guilty
    2. Not Guilty.

    But in reality as I see it we have 3 possible outcomes guilty, not-guilt and we don’t know (reasonable doubt). In our system when the jury can’t be sure one way or the other the system defaults to not guilty/innocent as the final verdict. This is what has got everyone in an uproar. It can be said that it was not proven that Casey was guilty but it was also not proven that she was innocent. We could all argue about the evidence for hours on end but as I see it the flaw in our system is 2 fold.

    1. incompetent jurors
    2. the equivalence of an undetermined state of guilt to innocence.

    I accept the fact that there will be cases where we will not be able to determine guilt but in those same cases we are also not able to prove innocence either.

    I propose that we change the system in this way. If a jury finds that they don’t know what the truth is then a verdict of not guilty is inappropriate. In other words an undetermined state is not equivalent to innocent. What I think should happen is that a mis-trial should be declared and a new jury found. If on the second try the new jury also has reasonable doubt the system should then default to the judge to make a determination. If the judge can not come up with a verdict. The person receives a verdict of undetermined guilt which is a state of neither guilty or not guilty and then released from jail. The big difference being if new evidence is found that person can be retried. There was more than enough circumstantial evidence in my opinion to prove guilt unfortunately the jury did not see it that way. Now if we find out something later we cannot retry her. In this case I believe a guilty person has been set free. As it stands right now it appears as if there will be no justice for little Caylee.

    Im not saying she is innocent, i think casey and her father knew everything about it. all im saying is that you cannot put someone to death with no evidence. They should have charged her with child abuse or wrongful death or something, but they wanted to make an example out of her. Its just like OJ if the glove doesn’t fit you must aquit. The bottom line is justice was served, just put yourself in her shoes especially if you were not guilty then what would you think? Or think about people you may know who have done time for something very questionable because they took a plea because they lost Trust in the system and have to live the rest of there life as a felon. Because they couldn’t afford a good attourney. There is a 98% conviction rate in this country and thousands are absolutely innocent. Because everyone thinks that nancy grace or a prosecuting attourney are right when they said they did it for the simple fact that they wouldn’t be here unless they did it. Or when one guy gets a d’dub and he gets a wrist slap and the next guy gets put through the ringer for the same exact offense. That’s the flaws in our system and good attourneys no how to work it to there advantage.

    It is my opinion that a guilty woman has been found not guilty of an unspeakable crime. However, everyone knows the old saying about opinions… Even if I didn’t believe that she killed her baby, how does a mother not report her child missing? Especially for that long!!! If my kids were missing for 30 minutes or more, I would be frantic.
    I really don’t think the race card has any place in this discussion. It was all about evidense and the way it was presented. Quite frankly, I get super tired of people (from both sides) saying that decisions are made simply because of the color of a person’s skin.
    And yes, Joe, she will face justice. She will eventually have to answer to God.
