Is Casey Anthony Guilty?

CORAL GABLES (LALATE) – Is Casey Anthony guilty? Will Casey Anthony be found guilty by her jury when a verdict is read in the next few days? Based upon the weight of the evidence presented by the State and the defense, that appears to be an easy question. The answer will be “yes”, Casey Anthony will be found guilty. The harder question is what will Casey Anthony be found guilty of committing. Did Casey Anthony kill Caylee Anthony accidentally or intentionally, and if she killed her accidentally, what could be Anthony’s possible conviction? That answer still remains unclear.
The Anthony family has spoken about Casey’s lack of “innocence”. They say that Casey is not innocent as to Caylee’s death. But innocent is not a legal term. When pressed this week, the Anthony family attorney would not indicate if the family believes Casey is “guilty” of first degree murder, felony murder, or manslaughter. So what do they believe?

Legal experts assert that Casey may have used chloroform to put Caylee to sleep and accidentally killed Caylee. Many experts contend this is the scenario that the Anthony family believes happened: an accidental use of chloroform at the hands of Casey Anthony. Unfortunately, if the jury believes the same, Casey could get felony murder, punishable by death.
Tonight, Casey faces the possibility of acquittal, first degree murder, felony murder, or aggravated manslaughter.
First, no one believes that Casey will get an acquittal. The accidental drowning argument has been a fabrication with no evidence. Just because a jury saw pictures of a swimming pool, they won’t conclude that Caylee drowned in that swimming pool.
Second, many experts believe that the first degree murder conviction hasn’t been proven either. The State claims that Casey used two items to commit murder – chloroform and duct tape. The tape hasn’t been proven convincingly. George and Cindy had access to the tape, not Casey. The State hasn’t proven that Casey plotted to kill her daughter with chloroform either. The State asserts that computer searches for chloroform proved premeditation. Cindy Anthony said she did those word searches.
However, on rebuttal, the State is prepared to produce Cindy’s work records to allegedly prove she was not at home when those searches were made. If in any manner the State fails to prove premeditation, you don’t have first degree murder.
That brings us to where this case could be decided. Did Casey commit felony murder or manslaughter? This remains the hardest question to date.
Third, a felony murder conviction could be reached if the jury believes Casey accidentally killed Caylee with the use of chloroform. Even if Casey did not intend to kill Caylee from the chloroform, if Casey used it on Caylee, she committed possible aggravated child abuse. Aggravated child abuse is a felony. And felony murder can be punishable by death.
Finally, a guilty verdict for aggravated manslaughter could result in a sentence of fifty years to life. That brings us to an interesting fact about Florida juries. To date, only one woman has received the death penalty for the death of her child, either via felony murder or first degree murder.

Just last month, Amanda Brumfield, Billy Bob Thornton, was charged exactly as Casey Anthony in a separate case. Brumfield was found not guilty of first degree murder and was convicted of aggravated manslaughter. In July we will learn her sentence.

The State has struggled to link the chloroform with Casey. If you don’t believe that Caylee died from chloroform, aggravated manslaughter is a possible conviction for Casey Anthony. LALATE predicts Casey Anthony will be convicted of aggravated manslaughter.
