CORAL GABLES (LALATE) – For Matthew Bartlett, tomorrow in the Casey Anthony trial won’t be TGIF. Matthew Bartlett would normally be working at TGIF as a server tomorrow. But after watching the Casey Anthony trial today, and giving a hand gesture, Matthew Bartlett landed himself in jail, for six days, plus fines.

Yes, Casey Anthony has still not been found guilty but Matthew Bartlett certainly has. And today, reports are that Bartlett will appeal. As if the Casey Anthony trial couldn’t get any crazier, Matthew Bartlett was in open court (in the presence of the jury today) watching proceedings Thursday. Jeff Ashton was at the podium. The TV camera was focus on Ashton (in the foreground) with Bartlett (in the background).

Suddenly Matthew Bartlett puts up his middle finger! Casey Anthony trial Judge Belvin Perry immediately dismissed the jury. Perry was furious. But more furious tonight was host Nancy Grace. She said the move by Matthew Bartlett could have cost the State a mistrial. Yes, after months of trial prep and testimony, one hand gesture by the guy at the local TGIF could have ruined the entire Casey Anthony trial.

Perry had a clerk take the notice off the front door and bring it in. He brought Matthew Bartlett to the podium. Perry asked Matthew Bartlett if he had read the sign which said no hand gestures are allowed. Perry then asked Bartlett if he can even read, if he has an education. Matthew Bartlett said he didn’t know what he was thinking, and was sorry.

Bartlett works at T.G.I.Fridays at Millennia Mall. He told the court his salary is about $15,000 a year and has $12 in savings. And with that, plus his incredible choice of hand gestures in a murder trial that has cost his State fortunes, Bartlett has also found love. Bartlett is engaged.

The judge had enough and sent him to jail for six days. Tonight Bartlett is serving six days in Orange County Jail (ironically the same jail as Casey Anthony). He also was ordered to pay a fine of $400, along with applicable court costs.

As soon as he was escorted away in handcuffs, his fiancee defended him on local news. FOX News reports “Bartlett’s fiancee … told the station that he thought Ashton was going after Anthony too hard and that she wasn’t getting a fair shake in court.” Bartlett tells news he is appealing and has already been given a public defender.

CORAL GABLES (LALATE) – Is Casey Anthony guilty? Will Casey Anthony be found guilty by her jury when a verdict is read in the next few days? Based upon the weight of the evidence presented by the State and the defense, that appears to be an easy question. The answer will be “yes”, Casey Anthony will be found guilty. The harder question is what will Casey Anthony be found guilty of committing. Did Casey Anthony kill Caylee Anthony accidentally or intentionally, and if she killed her accidentally, what could be Anthony’s possible conviction? That answer still remains unclear.

The Anthony family has spoken about Casey’s lack of “innocence”. They say that Casey is not innocent as to Caylee’s death. But innocent is not a legal term. When pressed this week, the Anthony family attorney would not indicate if the family believes Casey is “guilty” of first degree murder, felony murder, or manslaughter. So what do they believe?

Legal experts assert that Casey may have used chloroform to put Caylee to sleep and accidentally killed Caylee.  Many experts contend this is the scenario that the Anthony family believes happened: an accidental use of chloroform at the hands of Casey Anthony. Unfortunately, if the jury believes the same, Casey could get felony murder, punishable by death.

Tonight, Casey faces the possibility of acquittal, first degree murder, felony murder, or aggravated manslaughter.

First, no one believes that Casey will get an acquittal. The accidental drowning argument has been a fabrication with no evidence. Just because a jury saw pictures of a swimming pool, they won’t conclude that Caylee drowned in that swimming pool.

Second, many experts believe that the first degree murder conviction hasn’t been proven either. The State claims that Casey used two items to commit murder – chloroform and duct tape. The tape hasn’t been proven convincingly. George and Cindy had access to the tape, not Casey. The State hasn’t proven that Casey plotted to kill her daughter with chloroform either. The State asserts that computer searches for chloroform proved premeditation. Cindy Anthony said she did those word searches.

However, on rebuttal, the State is prepared to produce Cindy’s work records to allegedly prove she was not at home when those searches were made. If in any manner the State fails to prove premeditation, you don’t have first degree murder.

That brings us to where this case could be decided. Did Casey commit felony murder or manslaughter? This remains the hardest question to date.

Third, a felony murder conviction could be reached if the jury believes Casey accidentally killed Caylee with the use of chloroform. Even if Casey did not intend to kill Caylee from the chloroform, if Casey used it on Caylee, she committed possible aggravated child abuse. Aggravated child abuse is a felony. And felony murder can be punishable by death.

Finally, a guilty verdict for aggravated manslaughter could result in a sentence of fifty years to life. That brings us to an interesting fact about Florida juries. To date, only one woman has received the death penalty for the death of her child, either via felony murder or first degree murder.

Just last month, Amanda Brumfield, Billy Bob Thornton, was charged exactly as Casey Anthony in a separate case. Brumfield was found not guilty of first degree murder and was convicted of aggravated manslaughter. In July we will learn her sentence.

The State has struggled to link the chloroform with Casey. If you don’t believe that Caylee died from chloroform, aggravated manslaughter is a possible conviction for Casey Anthony. LALATE predicts Casey Anthony will be convicted of aggravated manslaughter.

CORAL GABLES (LALATE) – Krystal Holloway aka River Cruz (photos below) says George Anthony needs to take responsibility for the affair she claims they had. Krystal Holloway spoke about George Anthony on HLN’s Prime News this evening. She said the affair happened, that George Anthony is lying, and that she is sorry for her actions.

But what does this have to do with murder? “I am so sorry that I had an affair with an married man” Krystal Holloway told news tonight. “I paid for it, my children paid for it.” Holloway said she was in fact George Anthony’s mistress. But she added “I’m not trash. I know what I did was wrong. But he has to take some responsibility for it too.”

George Anthony clearly was left unbelievable about his interactions with Holloway. But that did nothing for the defense today. Holloway testified as to statements she claims George Anthony told her. The defense wanted the jury to believe that statements by Anthony can be used to prove the matter asserted. She claims that George Anthony said Caylee died of an accidental death.

The defense wants the jury to find that Anthony’s statements are proof of how Caylee died. The State says you can’t take a statement, outside the context of this courtroom, to prove an assertion. Moreover, there was an additional problem: George’s belief.

Did George say this statement because he believed that the death to be accidental or because he knew the death to be accidental? River Cruz didn’t make that clear on the stand. She didn’t make it on news today. But how do you get from cheating to murder? You don’t.

However, the defense is going after murder one with Holloway’s testimony. Legal analysts assert that the Anthony family believes Casey was in fact using chloroform to put Caylee to sleep at night, and accidentally killed Caylee. They don’t believe Casey intended to kill her daughter.

Unfortunately, if the cause of death if chloroform, even accidental, Casey could face felony murder. Felony murder is punishable by death, no different than first degree (premeditated) murder.

LOS ANGELES (LALATE) – Jonathan Rhys Meyer did not attempt suicide, confirm friends and multiple sources. A report by the Sun newspaper claimed Jonathan Rhys Meyer attempted suicide Tuesday night in London. But now friends of the actor state those allegations are false.

Jonathan Rhys Meyers has battled substance issues before. He has been in rehab five times. But Wednesday morning, he was released from a London hospital. What happened to the former star of “Tudors”? A source tells US Weekly “He did relapse and was hospitalized for that, but was released.” The same statement by an unidentified source was given to the Hollywood Reporter  Thursday.

Scotland Yard refused to comment about the matter. In statement issued to news, it said that “officers were called by London Ambulance Service following reports of a man refusing treatment. The man was taken to hospital.”

Meyers was transported from his home shortly before 8 pm Tuesday evening. His rep has yet to comment further about the matter. He appeared last year as King Henry VIII on Showtime. Previous roles include Bend It Like Beckham.

Headline News - Casey Anthony Case Skyrockets Ratings

LOS ANGELES (LALATE) – Headline News’ Casey Anthony trial coverage has surged the cable network’s ratings. Headline News, providing live coverage, the latest news updates, and legal analysts and recaps daily of the Casey Anthony drama, has skyrocketed ahead of larger traditional cable operators. Now news outlets are questioning if other cablers made a mistake in passing up live coverage of the trial.

During the O.J. Simpson trial, multiple network, cable, and local news channels would run around the clock live coverage. But in the years that followed, TV networks moved away from court coverage. Despite the growth of fascinating, often high profile cases, in the last five years, numerous cable channels dropped legal-oriented programming, live broadcasts, or entire programs devoted to trials.

That didn’t happen with Headline News. When the Casey Anthony trial start, Headline News was positioned as the only major cable network that decided to focus its entire slate of programming to the trial. Morning Express with Robin Meade covers multiple issues. But Meade ties in the Anthony trial before court sessions begin daily.

From there, Headline news has taken each of its blocks of programs, and talents, and devoted all of them to different aspects of the Anthony trial. Vinnie Politan and Jane Velez Mitchell have delivered for viewers two programs that add legal analysts of the wins and pitfalls of the defense case. By evening, Nancy Grace, even Dr. Drew, has continued Headline’s obsession with Casey.

But in the end, the big winner has been Headline News. Scot Safon, executive vice president and general manager of HLN, tells news this week that the cabler has skyrocketed in ratings. Even Dr Drew is beating Piers Morgan (CNN) and Rachael Maddow (MSNBC). Nancy Grace has jumped nearly 150% in ratings since the trial started.

The network has seen unprecedented gains, up to 902,000 viewers since May 24 compared 372,000 just the month before. Even HLN’s Joy Behar is beating MSNBC’s Ed Schultz.

George Anthony Suicide Note Gets to the Jury


CORAL GABLES (LALATE) – The George Anthony suicide note got the jury today on the State’s rebuttal case. The George Anthony suicide note is a big win for the State for one reason. The note makes no mention of Caylee Anthony’s cause of death. Legal analysts call the admission of the suicide note one of the biggest wins for the State to date.

Why? The assertion the State will make is that these are George Anthony’s final words. In a suicide note, Anthony, if he wanted to admit any wrongdoing, would have done so. If George Anthony wanted to admit he, not Casey, was involved with Caylee’s death, he would have written it. Even if Anthony knew how Caylee died, he would have indicated that as well.

The defense’s blunder got the George Anthony suicide note into evidence. On the defense case, they questioned Anthony about the note. “They opened the door” news analysts said this week “and the State drove a truck through it.”

The defense has consistently relied on innuendos and suggestions during this trial. Such was the case with George Anthony’s note. The defense suggested there was something in that note that simply wasn’t there.

So the State objected. The State responded by moving to get the note into evidence. The defense objected. The Court considered the admissibility issue for several days. And finally the Court ruled today that, on rebuttal, the State could get the note in.

By afternoon, the jury was reading the note. In it, George Anthony writes directly to Cindy. He thanks his son and his parents. Little is said about Casey. George Anthony writes that the reason for his suicide was to join Caylee in heaven.

The note was found in January 2009 when Anthony went to a local hotel, took several pills, and wrote these final words. He was eventually found at the Hawaii Motel on Ridgewood Avenue in Daytona Beach. He was taken to a local area hospital and was treated thereafter.
