James MacArthur - Dano Dead at 72


LOS ANGELES (LALATE) – James MacArthur is dead at 72. James MacArthur’s death was confirmed by family today; MacArthur died of natural causes. Best known as Detective Danny “Danno” Williams on Hawaii Five-0, James MacArthur was set to make a cameo in CBS’ breakout new hit series by the same name.

Executive Producer Peter Lenkov had told news just earlier this month that the two were actively discussing the appearance. Lenkov told EW! earlier this month “We’ve been talking to James about being on the show but he just doesn’t know because he’s busy with a business he’s launching. But we’d love to have him.” He said of his hopes for the appearance that “We have time.”

MacArthur died in Florida today. “Book em, Danno” was the phrase that Jack Lord’s Steve McGarrett popularized in the 1970s series. Other projects included Swiss Family Robinson, The Battle of the Bulge, The Truth About Spring, Cry of Battle, Spencer’s Mountain and The Interns.

Funeral arrangements have not been announced.

Cincinnati 1848 Daguerreotype is not First Photo of Humans


CINCINNATI (LALATE) – A discovered photo, a Cincinnati daguerreotype, is not the first photo of humans, says reports. A 1848 photo of Cincinnati taken by Charles Fontayne and William Porter and discovered by NPR’s Robert Krulwich is reportedly not the first photo of a human; and yet today, it’s dominating news for its historic importance. Brett Michael Dykes reports that the shocking find, while old, does not replace the “Boulevard du Temple” 1838 photo of Paris by Daguerre.

For days, photography historians have battled the news of the Cincinnati image. On Sunday, September 24, 1848, Fontayne and Porter were shooting images from the opposite side of the Ohio River. While not clear at first, NPR News’ Robert Krulwich points readers to a close up in the 1848 image. There, as Krulwich notes, are two persons near the water.

And while news of the discovery shocked historians, the image is not as historic as one by Daguerre himself years earlier.

Louis Daguerre ten years before took another image of a man getting his shoes shined on the streets of Paris. The image shows no traffic on the road; that is because exposure time was in excess of ten minutes. The man getting his shoes shine remained in place during that exposure time long enough, along with a person at the table nearby, that they were captured in the final image.

Notre Dame Student Dies - State OSHA Investigation Opens

SOUTH BEND (LALATE) – The death of a Notre Dame student is now under State OSHA investigation. Indiana investigators in the Notre Dame student death are expected to look at operation of a hydraulic scissor lift by a 20 year old student Wednesday. Indiana Occupational Safety and Health Administration spokesman Marc Lotter confirmed to Indiana news today that hey has already has on scene an investigator at Notre Dame.

Lotter confirmed that his agency has the ability to issue fines. He would not confirm if OSHA can call for additional penalties, nor when his investigation will be complete.

At issue is the hydraulic scissor lift. While Lotter did not speak directly about the lift today, local news confirms the junior who died Wednesday, Declan Sullivan, was on a hydraulic scissor lift at the time of his death. The hydraulic scissor lift is said to have been struck by wind gusts.

And despite the investigation, certain issues about the hydraulic scissor lift may already be clear cut. Comparing wind gusts reports from the National Weather Service at that time with the manufacturer’s guidelines for the lift could promptly indicate from the outset that the lift should not have been in place Wednesday.

Most of today’s hydraulic scissor lifts are manufactured to height and lift capacity maximums. Their engineering designs that allow for the lift only to be operated under certain weather conditions. And while many can extend 53 feet in the air and sustain 1500 lbs at any one time, their ability to sustain reported 50 to 60 mph winds like at Wednesday will be at issue for any investigation.

SOUTH BEND (LALATE) – Declan Sullivan, the Notre Dame student who died Wednesday, is remembered in memorial services Thursday. Declan Sullivan tragic death was preventable; in fact, Sullivan tweeted his potential peril moments before he died.

Declan Sullivan’s death leaves a campus in mourning. Most are searching for answers, how a 20 year old student was allowed to be up videotaping a college football practice high in the air less than one day after a storm, in 50 mph hour winds, and with complete knowledge that the winds were not letting up. Declan Sullivan had been up in the air when 60 mph winds were striking.

From his perch, he even tweeted “I’ve lived long enough”. As winds continued, he re-wetted his fear. Declan Sullivan’s Twitter account is private today. But the messages of terror this 20 year old junior sent out are being added to an investigation.

What was Notre Dame thinking?

Fingers are not being pointed yet as a campus mourns the loss of its fellow student. But even before investigation is set to look at the operation in place, clear standards appear to have been violated. Hydraulic scissor lifts, the device Sullivan was on, are reportedly not designed to be operated in excess of 20-28 mph according to manufacturer specifications. Of course, complete logic would tell you that no one should be up nearly 40 feet in the air in a 50 mph wind storm. Colorado State in 2000 had a camerman fall 30 feet in the air during a 50 mph wind storm. That camerman recovered.

Senior linebacker Brian Smith posted on his Twitter page: “In the midst of a season where you are disappointed with the outcomes… you can lose sight of what’s most important.’Sad day at practice. I will never forget today.”

Today is a day of mourning at Notre Dame. A memorial, a special Mass of Remembrance, is set in the Basilica of the Sacred Heart on campus.

LOS ANGELES (LALATE) – Maura Kelly is sorry for her “fatty” comments in Marie Claire. Now Maura Kelly is defending her Marie Claire job after she denounced the portrayal of overweight people on Mike and Molly (CBS). The tv series features two stars that fall in love after an encounter at Overeaters Anonymous. It’s a love affair that Kelly says doesn’t belong on TV.

Now some are wondering if Maura Kelly belongs in Marie Claire.

Maura Kelly’s remarks fumed series creator Mark Robets. He says the fatties post about his CBS series are hateful. He tells fancast, “It seemed like something someone would say when they’re really drunk at a party with their other hateful friends, but may be not good to write down and put it out for people to look at.” Roberts’ series averages a stunning 12.3 million viewers.

Kelly had written “I’d be grossed out if I had to watch two characters with rolls and rolls of fat kissing each other… because I’d be grossed out if I had to watch them doing anything”.

Marie Claire’s editor-in-chief Joanna Coles doesn’t watch the series. But she’s keeping Kelly. “Maura Kelly is a very provocative blogger. She was an anorexic herself and this is a subject she feels very strongly about.”

Kelly has added since “A few commentators and one of my friends mentioned that my extreme reaction might have grown out of my own body issues, my history as an anorexic, and my life-long obsession with being thin.”

Brett Favre Scandal Investigation Shifts with Allison Torres

LOS ANGELES (LALATE) – The Brett Favre scandal (photos below) investigation could be over if Allison Torres’ revelations are true. Allison Torres claims Brett Favre and Playboy model reporter Jenn Sterger regularly texted back and forth, that Sterger allegedly enjoyed it and wasn’t offended, and that Sterger allegedly boasts a collection of unclothed celebrity photos she has received via texts. And while Sterger denies Allison Torres’ claims, it is Torres, not Sterger, who has reportedly made herself avaialable to NFL investigator.

The Brett Favre scandal investigation had for weeks center around whether Favre sent Jenn Sterger unsolicited texts while at the New York Jets. Jenn Sterger is previously reported to have allegedly said that she thought Favre was “creepy”, that older and married men didn’t interest her, and that if she pursued anything with Favre she would end up in a garbage can.

Now Allison Torres is telling Steppin’ Out Magazine, as quote by New York news, that Sterger was not offended by Favre and his texts. She says Sterger and Favre sent mutual texts back and forth and that Sterger enjoyed the communication. Favre is reported to have admitted to NFL investigators last week that he did in fact send texts to Sterger, but not pictures.

Allison Torres’ claim is clear. She says that Sterger absolutely was not offended by Favre’s texts, that the two texted back and forth. She claims that Sterger did not want to hookup with Favre; but Torres also claims Sterger had no problem communicating, back and forth, with Favre via text messages.

“I just know they kept texting each other back and forth and that he wanted to hook up. I wouldn’t doubt she was enjoying the attention from him.” “[She] would keep saying to me, ‘I don’t know what to do’” says Torres. But she admits the texting didn’t stop.

But how about the Brett Favre picture? Torres contradicts Favre. She says Favre did send a picture to Sterger. “I actually saw it when he sent it. We just laughed when he did it.”

NBC Sports aptly notes that if Sterger “laughed” at the photos, then the NFL case could dramatically change. “[If true, it] would tend to suggest that [Sterger] wasn’t appalled or offended or scarred because of his actions.  In turn, it would tend to show that he didn’t commit … harassment.  In turn, it would tend to show that he didn’t violate the Personal Conduct Policy”.

Sterger’s manager, Phil Reese, is disputing Torres’ claims, however. Reese told the New York Post:  “This is someone who is clearly trying to exploit an unfortunate situation and capitalize on the opportunity to see her name in print.”

Torres doesn’t end there. She said that Sterger has collected countless photos of unclothed celebrities. “She could make millions if she ever cashed in on all the [uncloted] photos she gets from friends.”

Unlike Sterger, Torres has reportedly made herself available to NFL investigators, claims NBC Sports. “This is someone who is clearly trying to exploit an unfortunate situation and capitalize on the opportunity to see her name in print,” says Sterger’s manager Phil Reese.
