Elena Kagan, Justice Sonia Sotomayor, and federal judge Diane Wood remain on the short list tonight follows unconfirmed but prevailing reports that Souter will retire the end of this term.

Sotomayor would along with Justice Cardoza be the only Hispanics to serve on the court. Sotomayor’s name came up as a possible choice in 2005 to replace O’Connor under the Bush Administration.

Just this April, Senators Charles Schumer and Kirsten Gillibrand sent off a memo to Obama asking that Sotomayor be considered the first pick if any seat comes vacant.
